Please read carefully the Terms and Conditions of access and use. If you do not agree to the terms of use, please do not use our Site. If you continue to use our Site, we will consider that you have read and understood these Terms of Use and their effect on you.

The Site is under continuous improvement, with the Company (as defined below) constantly trying to implement new features. Therefore, these Terms may be influenced by these changes. We reserve the right to make changes to the Site and these Terms at any time by posting on our Site, without any further notice, unless the amendments have a legal impact, in which case we will inform you using the email address you provided when you created an account within the Site. Please reread the Terms regularly to stay informed of the most recent version.

  1. INTRODUCTION. APPLICABLE LAW

1.1 The terms and conditions of access and use ("Terms") of the website www.undelucram.ro ("Site") represent the regulations for the operation and use of the Site, which become mandatory for all users, whether or not they create an account on the Site.

1.2 In this document, the following terms shall have the meanings described below:

  • "Company" or "we" means the company UNDELUCRAM SRL, with its registered office in Cluj-Napoca, 22-26 Regele Ferdinand Street, Central Shopping Center, 3rd floor (correspondence address: 6L Iuliu Maniu Boulevard, Campus 6.1, 3rd floor, Sector 6, Bucharest), registered with the Trade Register under no. J12/2388/2019, fiscal code 37266398, email office@undelucram.ro; the Company is the exclusive operator of the Site.

  • "User" or "You" means an individual or a representative of a legal entity who accesses and uses the Site by creating a user account or by personalizing an existing Employer profile;

  • "Visitor" means an individual who accesses the Site or its sections without creating an account within it;

  • "Employer" means any of the legal entities whose profile is available on the Site, whether personalized by a User or not.

 

1.3 Through the Site, we aim to:

  • Provide information about the working environment in Romania, information provided by individuals who interact or have interacted professionally with Romanian employers whose public profiles are available on the Site;

  • Provide public interest information from various fields related to the labor market, such as human resources, job market, salary, etc., structured both in the form of articles (either created internally or taken from other public websites) and in the form of forum discussions;

  • We offer the possibility for Employers to customize their public profiles available on their page within the Site, by publishing announcements about available jobs or internships; uploading an introduction to the Employer; collecting the ratings provided by Users within the Site, about that Employer; collecting information about the salaries and benefits that are granted by that Employer;

  • Provide Users with the opportunity to add and complete their CV within the Site; evaluate the experience during interaction with certain Employers; post information about the salaries and benefits offered by a certain Employer; compare salaries; access informational resources.

1.4 These Terms are subject to Romanian law. Any dispute arising out of or in connection with the use of the Site shall be settled by the competent Romanian courts and/or authorities.

 

  1. CONTENT AND SECTIONS OF THE SITE

2.1 The Site hosts numerous online informational resources, including communication tools, articles, news, forums, and social interaction services. The Site is intended for Visitors, Users, Contributors, and Employers alike.

2.2 The Site is structured into multiple sections, as follows: sections accessible to Visitors / Users / Contributors / Employers.

2.2.1 Sections accessible to Visitors / Users / Contributors:

b) The Salary Guide section, dedicated to centralize articles about the salary market in Romania. The articles are both created by the Company and taken from other public websites. Additionally, the section provides a comparative analysis of salaries available on the Site, segmented by industry, average salary, and graphs with salaries for specific calendar months.

c) The Create Online CV section, dedicated to centralize various CV templates that Users can use to create a CV to be used within the Site.

d) The Cumlucram section, dedicated to centralize the latest articles and news from various fields such as human resources, job market, salary, etc.. In this section, Contributors can provide articles to share their academic or professional experience with other community members.

e) The Salary Meter section contains an application intended to be used for simulations/estimations regarding salary calculations.

f) The Top Employers section contains rankings based on various criteria: overall rating, career opportunities, compensation and benefits, work/life balance, management, industry, and culture and values.

g) The Jobs section, where job postings published by Employers can be viewed and filtered based on various criteria.

h) The Rate section, where Users can add information about their experience interacting with a particular Employer.

i) The Recommendation Meter section, where the User receives job and company recommendations to apply to, based on data from the CV and/or completion of job interest and skills sections.

j) The Job Interview section contains useful information and news for the User regarding interview preparation, accessing the Recent Interviews and Salaries section.

k) The Job Search section is dedicated to provide useful information for the User searching for a job and accessing the Recent Jobs section.

l) The Add Your CV section allows the User to create/upload a CV, access active jobs, leave a review, consult useful information, and manage personal information from their Undelucram.ro account.

m) The Salaries section, where you can view the latest salaries in the market added to the Site.

n) The Interviews section contains recent evaluations of interviews held at companies published by other users.

o) The Net or Gross Salary Calculator 2024 section contains an application intended for calculating net and gross salaries in 2024, useful information regarding salaries, and accessing information from the Recent Jobs, Recent Salaries, and Recent Interviews sections.

2.2.2 Sections accessible only to Employers

The Employer Section of Undelucram, enables a User, upon creating an account on the Site and possessing representational powers of an Employer, to manage and customize the Employer's profile on the Site. Additionally, they can interact with other Users publicly on behalf of the Employer.

There is also the possibility of adding customized tabs, such as: Youth Programs, Blog, etc.

This section encompasses several subsections, a representative part of which is presented below;

 

  1. The Recruiting Solutions section allows the User with employer representation powers to post job announcements on the Site, view (1) a list of all available job positions uploaded by the represented Employer, along with (2) specific statistics regarding User/Visitor interaction with each of the announcements uploaded by the Employer, and consult interested candidates who wish to apply for the jobs published by the represented company. Additionally, they can submit to the Company a link to an Application Programming Interface (API) product, along with usage instructions, enabling the Company to display job announcements relevant to that Employer by querying the provided link as indicated by the User with employer representation powers. By using this option, the User with employer representation powers and/or the represented Employer are solely responsible for the instructions and link provided, as well as for the proper functioning of the link and the clarity and completeness of the instructions.

 

  1. The Employer Branding section allows the User with employer representation powers to complete sections providing information about the company they represent: 

  • Overview;

  • Profile Cover Image;

  • Internship;

  • Benefits;

  • News;

  • Photo and Video Gallery;

  • Social Networks;

  • Widgets.

The User and the Employer represented by the User assume sole responsibility for the legal effects that uploading those photos to the Photo Gallery may have on other individuals.

 

  1. The Analytics section enables Users with employer representation powers to customize and analyze data regarding activity on the Site and interactions within it, especially those involving Users and Employers considered competitors of the represented Employer.

  2. d. The Salary Report section allows the User with employer representation powers to access relevant data about market salaries.

  3. The Top Employers section contains rankings based on various criteria: overall evaluation, career opportunities, compensation and benefits, work-life balance, management, industry, and culture and values.

  4. The Transparent Employer Certification section contains the criteria for obtaining Transparent Employer certification and the status of each criterion for the company represented by the User.

  5. The Services and Orders section allows the User with employer representation powers to access the services and orders they have purchased on the Site.

 

2.3 The content hosted on the Site originates from various sources, such as: articles and news created by the Company, contributors, or sourced from other websites, information provided by Users, and data uploaded to the Site by Employers.

2.4 The content hosted on the Site is provided, without charging any access fee, to any Visitor and/or User. However, certain types of content are only accessible to Users.

2.5 Additionally, certain sections of the Site are accessible after making payments representing the cost of certain services that the Company, through the Site, can provide to Employers. Therefore, there are two types of packages available to Employers: Basic (free) and Corporate (paid). Each of these includes certain services.

2.6 Under no circumstances will the Company restrict the right to freedom of expression by deleting messages from Users in exchange for money from Employers, nor will it include such a possible service in the services provided to Employers.

 

3. REGISTRATION AND SECURITY OF SITE USAGE

User/Visitor Security

3.1 In order to access certain sections or functionalities of the Site, it is necessary to create a User account.

3.2 To complete the registration process, you will need to fill out the registration form available on the Site by providing a username, email address, and a password, or register on our Site through a social networking site: Facebook, Google, or LinkedIn.

3.3 After completing and submitting the registration form, you will receive a message at the email address provided by you, confirming your registration. To validate your User account, it is necessary to access the received email.

3.4 Each User's account is secured by a password chosen by the respective individual. It is your responsibility to keep your password and account security confidential. Consequently, you are solely responsible for all activities that occur in your account. If you have any suspicions regarding unauthorized use of your account, please contact us immediately using the email address office@undelucram.ro or using the Feedback button available on each page of the Site. Also, make sure to log out of your account every time you finish your browsing and use of the Site.

3.5 Each User is limited to one account. We endeavor to maintain this policy by mandating the submission of an email address during the registration process on the Site. Unauthorized use or sharing of another User's account is strictly prohibited. It is the responsibility of each User to safeguard the confidentiality of their username, password, and any other access information associated with their account. We cannot be held responsible for any unauthorized use, disclosure, or loss of these details resulting from a User's failure to comply with this obligation.

3.6 Users are required to comply with the following information at registration and use:

  • to be at least the legal employment age (16 years); the Site is not intended for individuals below this age, especially considering their legal inability to be employed before this age.

  • to provide real and up-to-date data, especially regarding the information presented in their CVs; in the absence of current and real information, the user experience of the Site may be suboptimal.

3.7 During the use of the Site, certain personal data belonging to Users/Visitors is processed by the Company. All information regarding personal data is available in the Personal Data Processing Policy available here.

3.8 Visitors are guaranteed that the Site does not contain software programs or components that could adversely affect the performance and operation of the device used to access the Site.

 

Security of Employers

3.9 The Company makes constant efforts to ensure that all Users who activate profiles of Employers can represent those Employers based on the contractual relationship between Employers and Users who wish to activate Employer profiles.

3.10 If the Company receives written requests, along with relevant evidence, from Employers indicating that their accounts on the Site have been activated by Users who lack the necessary authorization from the Employer in this regard, the Company will collaborate with the Employer to determine the extent of illegitimate use of the Employer's account on the Site by a specific User. However, the Company will not deactivate the Employer's account activated by an unauthorized User solely upon a written request, unless substantiated, from an Employer.

3.11 The User managing an Employer's account is responsible for the contributions and actions performed by that Employer within the Site. In the absence of a well-founded written request from an Employer, the Company will not intervene in the actions carried out by an Employer within the Site.

3.12 The Employer's account is developed so that it can be accessed by only one person at a time. The Employer may designate multiple individuals with whom it has contractual relationships allowing the representation of the Employer within the Site to operate the Employer account alternatively. The Employer is fully and exclusively responsible for the security of its account within the Site.

 

  • 4. USER USAGE AND CONDUCT RULES

4.1 We provide you with the opportunity to share, within the Site, your impressions and experiences regarding the time you have spent or are spending as an employee or collaborator of an Employer, in the section dedicated to hosting information about Employers.

4.2 You are solely responsible for the accuracy and truthfulness of the information, data, and messages you provide. We do not assume any obligation to investigate the truth of the statements, to monitor or verify the accuracy, completeness, or compliance with the applicable law of your comments and published content.

4.3 When submitting a comment for publication, you are fully responsible for any comment that:

a) violates any applicable law in Romania (for example, legal norms regarding defamation or the right to privacy, dignity, or image) or a contract you have signed with the Employer about which you are publishing the comment (for example, copyright or a confidentiality clause);

b) it has an obscene, insulting, defamatory, threatening, violent, abusive character, expresses hatred, incites harassment or discrimination on any criteria, is pornographic or profane, or encourages behavior that would be considered a crime or a violation of the law; also, any personal attacks are strictly prohibited. Treat other Users with respect and keep discussions within the bounds of decency. The Company reserves the right to remove comments that are reported by other Users as violating this paragraph or that are blatantly contrary to this paragraph.

c) is of a "spam" nature or represents any other form of unsolicited advertising, promotional materials, or commercial messages, except where expressly permitted. The Company reserves the right to remove comments that are reported by other Users as violating this paragraph or are blatantly contrary to this paragraph.

4.4 Please use correct Romanian language (use complete words, commas, periods, and hyphens). Also, please do not use "chat" language. Check the text before submitting it.

Ensuring clear and understandable language is crucial for effective communication with other visitors to the site. It enhances readability and facilitates comprehension, thereby improving the overall user experience.

4.5 Do not excessively quote from previous comments; only quote essential parts so that comments are easy to read. Please specify the name, ID, or nickname of the author of the comment you are quoting. Posting quotes without personal contribution or without specifying the source/author is prohibited. Messages of this kind will be deleted. It is prohibited to use the name, ID, or nickname of an Employer, brand, or personal webpage.

4.6 Approved contributions published on the Site (comments, reviews, salary information, interview process information, and benefit package information, etc.) can be edited or deleted by the author within 48 hours of publication. Considering that each contribution is an individual and subjective perception of each User, these may change, so we grant each User a period of 48 hours to review their own contribution. After the 48-hour period, contributions cannot be modified to maintain continuity of discussions. If Users wish to evaluate Employers they have previously evaluated, they can do so after a minimum of six months from the previous evaluation.

4.7 Once a comment is published, you grant us a non-exclusive, irrevocable, unlimited license in Romania to reproduce, publish, transmit, and broadcast it for the purpose of exploiting and promoting the Site.

4.8 Any deviation from the above obligations will be penalized by deleting your comments and/or restricting your access to this Site. This right we reserve should not be construed as our approval or responsibility for your comments or content uploaded to the Site, whether or not we exercise this right.

4.9 You are required to indemnify us for any direct or indirect damages we may suffer as a result of publishing content, comments, or materials posted or sent by you on our Site and that have not been refused for publication or deleted after publication (not having an obviously illegal or harmful character for us).

4.10 It is prohibited to: 

a) reproduce, copy, distribute, or exploit the Site, including any part of its content for any purpose, without obtaining our prior written consent; 

b) download or copy information for the benefit of another business; 

c) use data extraction tools, robots, or similar data collection and extraction tools.

4.11 You do not have the right to introduce viruses or other technologically harmful materials, attempt to gain unauthorized access to our Site, or attack the Site. Any such abuses, which may constitute offenses, will be reported to the competent authorities.

 

5. MESSAGE APPROVAL AND MODERATION RULES, INCLUDING REVIEWS, SALARY INFORMATION, INTERVIEWS, AND OTHER DATA PROVIDED BY USERS

5.1 The Site is intended to be a reference point and information source for those seeking employment, those interested in the atmosphere and working environment of Romanian companies, as well as for companies aiming to improve their relationship with current and future employees.

5.2 The Company remains neutral in all discussions between Users and/or Employers and does not conduct investigations to discover the authenticity of message content (including reviews, salary information, interviews, or other data provided by Users). Therefore, you are obligated to provide real data that can be helpful and interesting to all Site visitors.

5.3 The Site is moderated by a team that analyzes messages received through the Site and approves all messages that appear to comply with these Terms. Additionally, Site moderators will consider the following aspects:

a) The same standard of moderation/approval/rejection of messages applies to all messages received (including reviews, salary information, and interviews or other data provided by Users), regardless of whether they come from former employees, current employees, or Employer representatives.

b) Information provided by Users must be of interest and helpful to Site Visitors and/or Users.

c) General messages lacking interest to Site Visitors and/or Users or messages lacking arguments will not be accepted for publication (where the situation requires).

5.4 The Company reserves the right not to publish opinions that contravene the Terms or that it considers harmful in any form to its own image, partners, or third parties, and will inform the commenting User of this aspect.

5.5 The Company provides Users and Employers with the opportunity to officially dispute information that does not conform to reality by exercising the right to reply on the Site or by informing Site representatives immediately.

5.6 If we are notified of violations of the law or contracts, we will only delete those comments and materials for which clear and indisputable evidence of the alleged violations is provided; in the absence of such evidence, we will respect the right to freedom of expression of Users' opinions.

 

6. LIMITATION OF LIABILITY

6.1 The Company does not guarantee the accuracy, correctness, or timeliness of the information hosted on the Site. If it is believed that any information hosted by the Site violates the legal rights of the individuals or legal entities concerned, it is necessary to report this situation to office@undelucram.ro, together with precise and relevant evidence that refutes the hosted information.

6.2 The Company does not endorse the opinions expressed by publication. The Site has a neutral role, facilitating public access to labor market information. We disclaim all liability (whether based on contract or otherwise) arising out of or in connection with access to or use of our Site or any website linked to it, to the extent permitted by applicable law, except for losses or damages caused by fraud, intentional misconduct, or gross negligence.

6.3 User-provided data at registration cannot be made available to anyone except as required by law and except in the situations described in the Personal Data Processing Policy available here.

6.4 The Site may not always be available and may have certain errors. Therefore, you use it at your own risk, without warranties of any kind from the Company.

6.5 The Site may contain links to third-party websites, which are clearly marked as such for easy identification. Our inclusion of any link to a third-party site does not imply that we endorse, recommend, or accept responsibility for such third-party site, its content, or its use, or the use of any products or services made available through it. We are not obligated to filter or monitor and have not investigated or monitored any third-party site for accuracy, completeness, or compliance with applicable law. We are not responsible for any damages or losses caused by your use of the Site or reliance on these third-party sites, which you use at your own risk under the conditions stipulated on these sites.

6.6 You may create a hyperlink to our Site from another site or document without our prior written consent subject to the conditions set forth in this clause. A hyperlink does not imply that we endorse your products or services or any of the products or services of the site on which you insert the link to our Site, or available through it. To the extent that we identify a hyperlink as being placed on a site that has illegal, threatening, defamatory, obscene, pornographic, or profane content, or that could constitute or encourage behavior that could be considered a crime or a violation of any law or that, in the Company's interpretation, harms or may harm the interests or reputation of the Company and the Site or the companies we work with (or our and their products and/or services), we will resort to legal remedies to request the removal of that hyperlink from the site that violates this clause.

6.7 We reserve the right to request at any time, at our discretion, for any reason, that any link you create to our Site from another site or document be removed. In this case, we will send you a termination notice to the name listed on your domain name registration or to any email address provided on your site. You will be required to remove the hyperlink within 5 days of receiving the notification.

 

7. INTELLECTUAL PROPERTY, TRADEMARKS, COPYRIGHT, AND SOFTWARE

7.1 UNDELUCRAM is a registered combined trademark exclusively owned by the Company and may not be used without the prior written consent of the Company.

7.2 All intellectual property rights to the Site, including its content, design, graphics, logos, images, audio/video clips, belong exclusively to the Company.

7.3 Posting comments and content by you as a User does not grant any rights or title to the Site.

7.4 All copyright to the software programs used on the Site belongs to the Company, except for open-source software. All software content, its development, and the software as a whole are protected by copyright laws. Any other use, including reproduction, modification, distribution, transmission, republication, display, or performance of the content of this site is not permitted without the prior written consent of the Company.
